On May 6, 2004, Jewish World Review published an analysis of RLUIPA's constitutionality as held by the 11th circuit court of appeals in Midrash Sephardi v. Town of Surfside. The article, written by Becket Fund attorney Roger Severino, argues that RLUIPA is a measured and necessary response to widespread discrimination against religious land uses and that the court decision in Midrash is now the strongest court acknowledgement of this fact.
